The hearing of an appeal case challenging the election of Migori Governor Zachary Obado has been completed before a three judge bench in Kisumu.
Making his presentation, appellant Lead Council Musalia Mwenesi challenged the ruling of the petition which reinstated Obado to the Governor’s seat.
Mwenesi says the High Court in Homa Bay did not fully analyze the petitioner’s evidence in dismissing the petition that had been filed by Edward Oyugi.
Oyugi had alleged that the March 4 election was marred by irregularities and wanted the declaration of Obado as winner nullified.
Mwenesi however maintained that Oyugi had won the election by a margin of 174 votes after scrutiny of the tallying.
He also opposed the Sh1 million petition costs which the high court had directed to be paid by Oyugi claiming that it is IEBC which caused all the errors in the election process.
In his response, Obado’s lead Counsel Roger Sagana expressed satisfaction with the High Court ruling saying the few errors in the tallying were minimal but also favored both the candidates.
The three judge-bench led by Justice Onyango Otieno set the judgment date for April 4, 2014.
