Mr Mark Kitaanyu Ole Karbolo enjoyed a rare victory against President Uhuru Kenyatta on his earlier appointment of Bill Lay as the chairman of African Portland Cement Chairman. He had earlier moved to court to stop the president’s exercising of his powers conferred to him by section 7(3) of the state corporations Act.
“, I Uhuru Kenyatta, president and commander-in-chief of the Kenya Defence Forces appoint William Lay to be the chairman and director of the East African Portland Cement Company, up to November 7, 2014 with effect from 22nd January, 2014 and revoke the appointment of Mark Kitaanyu ole Karbolo,” says the gazette notice dated February 7.
This Gazette notice had allowed the government an opportunity to temporarily take charge of the state corporation under Bill Lay as Chairman of the Board but which the Court found illegitimate quashing the previous appointment.
This is a clear sign of the democratic space the justice system can provide to its citizens over and above all powers in the land given a chance.
