High Court sitting in Kisumu has moved that the case challenging the legality of David Sifuna as Trans Nzoia County Speaker be heard on 20/11/2014.
This is following a petition by lawyer Barasa Nyakuri to have the court interpret and determine the removal of David Sifuna as the Trans Nzoia County Speaker.
This comes after Sifuna served for over a year without gazettement of his election which was done sometimes a year ago.
In the petition that seek to have Mr. Sifuna punished on violation of the constitution, abuse of rule of law, abuse of office, impersonation and incompetence.
He is also accused of assaulting clerk of the Trans Nzoia Assembly, misappropriation of funds and frauding the assembly, Mr. Nyakuri said that Sifuna, in his roles and functions assumed and undermined the powers and functions of the county assembly clerk contrary to section 13 of the county government act.
The court also heard that the case was first filed in Eldoret High Court by the petitioner lawyer Nyakuri before it was transferred to Kitale High Court on administrative boundaries which were objected by the petitioner on grounds of his freedom and security after he alleged to have been confronted by the speaker’s supporter, an act that Sifuna denied.
However appearing before Justice Maina directed Nyikuri to serve the other party with new summons directing them to present themselves before the Kisumu High Court next week.
