Court of appeal sitting in Kisumu High Court has barred the Kisumu County Assembly Speaker Ann, from serving in her position pending the hearing of the appeal.
The three judge bench led by Judge David Maraga gave the ruling after the two sides failed o come to and to agreement.
This comes barely few days after 37 County Assembly members boycotted the reopening of the county’s 3rd session, which clearly indicates the division between the County Assembly legislatures.
Appearing for the Speaker Ann Adul, lawyer Ken Okong’o indicated that his client refused on an agreement with the applicant to stay since her rights were earlier violated.
Okong’o further noted that the speaker should be allowed to carry out her constitutional roles as no other speaker should be elected and the County Assembly operates as usual.
However giving their ruling, the three judge bench directed that the applicant led by lawyer Paul Muite and the respondent led by lawyer Ken Okongo to file and serve each other with written submissions not less than 10 pages within 7 days.
The court further ordered that the industrial court’s earlier ruling reinstating Speaker Ann Adul to her position to be stopped pending the hearing of the appeal on 3rd march 2015.
Kisumu County Assembly Speaker Ann Atieno Adul was impeached late last year by Kisumu MCAs over listed gross misconduct.
39 Kisumu MCAs voted to have her impeached, while only three of the MCAs voted to keep her in the job while 6 others abstained from voting.
The motion was moved by West Nyakach Ward Representative James Omollo sought to the impeach the speaker when she was outside the parliament buiding and as the impeachment was going on the speaker moved to court and obtained court orders stopping them from discussing that matter in the assembly, which has culminated to the whole court process that the Kisumu residents are witnessing today.
